What legal function should my company have? That is
the question that many managing directors, financial
officers, heads of legal departments and in-house lawyers
are asking themselves today.
Indeed, the pressure of law is quite considerable. Criminal
law aspects receive wide media coverage. Generally, the
company has to enjoy “legal security” and
needs “legal optimisation”; how can legal
risks be recognised, avoided, managed and used to good
purpose?
In order to fulfil this major requirement, companies
have to have a high-performing legal department that
is adapted to their specific needs. This organisation
raises several issues:
What roles will the legal function pay?
How can a minimum legal function be set up?
How can the legal function be optimised?
What lawyers does the company need?
What place is given to the legal function within
the company?
Legal function and tax function: should they be in
the same department or separate?
How and when should external advisors be used?
How should legal information be handled?
How is the legal function’s performance measured?
